As noted on the listings for mining claims, the federal govt. owns the land being in a national forest, and claim owner owns the mineral rights for prospecting.
You own the mineral rights, including gold and gems on the claim, as real property, being the same legal ownership as for land and homes.
You can camp with a tent or RV as you prospect.
The BLM allows 14 overnight camping days per month where you do not need permission nor a permit to do so. For more than 14 days, the claim owner needs to file a Plan of Operation with the BLM for approval.
For any building like a shed, you need to file a Plan of Operation with the BLM for approval. For anything to live in, you would need to file a Plan of Operation with the BLM for approval, and to be considered, you would need to have developed a full-time mining operation.
You cannot though build or put anything just to live in.
You keep a claim forever by doing a simple form and $200 to the BLM each year.
I have paid the fees for the next claim year so are not due again September 1, 2026.
Now that I have located the claims, you never have to declare to the BLM any gold or gems you find.
You can prospect as little or as much as you choose.
A claim owner does not need permission nor a permit to camp and prospect.
